01Agreeing to these terms
These terms are an agreement between you and Vornox OPC Private Limited (“Simenity”). By creating an account or using Simenity you agree to them. If you use Simenity for a company, you confirm you can bind that company, and “you” means the company.
02Your account
You must be at least 18 and give accurate details. Keep your login secure; you are responsible for activity under your account. Tell us at once if you think someone else has used it.
03What Simenity does
Simenity reads a web page you submit, builds audiences from it and from your inputs, and simulates how those audiences might respond to the page on the ad networks you choose. It returns predicted ranges, objections, suggested fixes and generated variants.
04Predictions are not guarantees
Every result Simenity gives is a simulated estimate, shown as a range. It is not a measurement of real users and not a promise of real click-through, conversion, cost or revenue. Real campaigns depend on things we do not see: your creative, bids, budgets, competition, timing and the networks’ own systems.
Use Simenity to rank ideas and find problems early, and confirm decisions with a live test. You are responsible for the campaign decisions you make.
05Your content
You keep all rights in the pages, text, images and other material you submit (“your content”), and in the results generated for you. You give us a limited licence to access, copy and process your content only to provide and secure the service for you.
You confirm you own your content or have permission to submit it, and that our processing it as described will not infringe anyone’s rights or break any law.
06Acceptable use
You agree to follow the acceptable use policy. We may suspend runs or accounts that break it.
07Plans, payment and taxes
- Free simulation: each new account can run one simulation without a card. One per person or company.
- Pay as you go: each simulation is paid for in advance and includes ten cycles.
- Monthly plans: Pro, Growth and Agency are billed monthly in advance and renew automatically until cancelled. Monthly simulation allowances do not roll over unless your plan says so.
- Extras: extra simulations and cycles on paid plans are charged at the rate shown in the app when you buy them.
- Prices and taxes: prices are in US dollars and exclude taxes such as GST or VAT, which are added where required. We will give you at least 30 days’ notice of a price change to an existing plan.
08Cancelling and refunds
You can cancel a monthly plan at any time from billing settings. Refunds are covered by the refund and cancellation policy.
09Our property
Simenity, its software, models, designs, brand and documentation belong to us or our licensors. These terms give you a right to use the service, not ownership of it. Do not copy, resell or reverse engineer the service, or use it to build a competing product.
10Third-party services
Simenity names and simulates third-party ad networks such as Google, Meta, LinkedIn and TikTok. We are not affiliated with or endorsed by them, and their names and logos belong to their owners. Pages you submit may link to third-party sites we do not control.
11Availability and changes
We work to keep Simenity available but do not promise it will be uninterrupted or error-free. We may change features; if a change materially reduces what a paid plan includes, we will tell you in advance and you may cancel for a pro-rated refund of the unused period.
12Disclaimers
Except as these terms expressly say, Simenity is provided “as is”, and to the extent the law allows we disclaim all implied warranties, including fitness for a particular purpose and that results will be accurate or achieve any outcome.
13Limits on liability
To the extent the law allows, neither party is liable for indirect or consequential losses, or for lost profits, revenue, ad spend or data. Our total liability arising from these terms in any 12 months is limited to the amount you paid us in those 12 months, or USD 100 if greater. Nothing here limits liability that cannot be limited by law.
14Indemnity
You will defend and compensate us against claims from third parties arising from your content or your breach of these terms or the acceptable use policy.
15Suspension and termination
You can close your account at any time. We may suspend or close an account that breaks these terms, puts others at risk, or has not paid, and will give notice where we reasonably can. When an account closes, we delete its content as described in the privacy policy.
16Changes to these terms
We may update these terms. For material changes we will give at least 14 days’ notice by email or in the app. If you keep using Simenity after a change takes effect, the new terms apply.
17Governing law
These terms are governed by the laws of India. The courts at [city], India have exclusive jurisdiction, except that either party may seek urgent relief in any competent court. If you are a consumer, you keep any protections the law of your country gives you.
